You pick up several coupons from the floor and notice that your neighbours seem to care less about a clean neighbourhood than you do.
When you enter your apartment, you throw your jacket on the coat hook and slip out of your shoes. You drop the newspaper on the kitchen table and start warming the leftovers from the day before. Yesterday you and $herName cooked dinner together.
While you're warming your food, you take a quick look at the paper. The headline on the front page reads:

You notice that your food smells burnt! Hastily you start stirring and switch the stove to a lower setting. The food is quickly ready - and eaten even faster. After you have done a few more things, you brush your teeth. You think back to the headline in the newspaper and get the newspaper.

You are especially happy today, because you are rehearsing some new pieces for the concert in a few weeks. Recently you bought a new bass. This has given you extra motivation to practice regularly at home.

The constant snide comments of $guitarist don't annoy you anymore.
As soon as $drummer joins the group, you start practicing. You are well prepared and don't make any mistakes. But the others don't seem to have practiced that much.
You're a bit annoyed. As the others ask you if you join for a beer:

Right after dinner, $herName goes home. Saing goodbye she adds:

You don't understand why you reacted so violently. In a bad mood you do the dishes. Afterwards you watch some TV until the wine bottle is empty.

Due to several unrelated riots and unauthorized demonstrations at train stations, changes in the law have been decided. The aim of the changes is to give the police access to the video surveillance infrastructure already in place and operated by the national railways SBB.

Since <b>it cannot be used to tap telephone conversations</b> or monitor SMS conversations, the question of privacy is not given much weight. <h3>Introduction</h3>Recently, amendments to the law were passed. They aim to give the police direct access to the video surveillance of the national railways SBB. Two laws were adapted for this purpose. <b>A referendum was held against the amendment.</b>
<h3>Amendment 1: Federal Act</h3>The first amendment concerns the <b>Federal Act on the Carriage of Passengers (PBG Passenger Transport Act)</b> [[Article 55|BÜPF]], paragraph 5 of the Federal Act.
New is to stand there: <i>"Records will be made directly available or directly accessible to prosecuting authorities or agencies as part of cantonal threat management."</i>

As I mentioned, there's no charge held against you. Nevertheless, your behaviour towards $herName is inappropriate and you are asked to withdraw yourself from $herName as she feels uncomfortable. Many of the factors that went into the risk assessment software indicate a stalking tendency. It shows only a slightly increased risk. Therefore you will not need to come to the police station regularly.
I will contact $herName in a few days and ask if the situation had improved. If everything is fine, I only contact you by phone and discuss the next steps with you.
You still bring some points into the conversation. You mention that you have never made any threats and that you do not understand why a possible dismissal becomes an issue. Even when Mr. Müller patiently explains your view of things to you, you feel cornered.
When it becomes obvious that the discussion is going round and round, your objections subside. You don't feel understood, while Mr. Müller tells you that everything will be all right if you distance yourself from $herName. He will contact you in the next few days as agreed, he says as he accompanies you out of the room;

</ul>No one reacts in surprise to your statement. All her friends seem to have known about it. You wind yourself out of the arms of $drummer and $singer, take a step towards $herName. But before you can get a hold of her, $guitarist intervenes. $drummer and $singer have gotten their act together too and are pulling you back. Talking to you they won't let go and pull you back to your corner of the bar.
While $singer is getting another round, $drummer is appeasing you. Your feelings go round and round, your head's spinning, too. You don't move, even as you realize that $guitarist is having drinks with $herName and seems to calm her down. As $singer brings the drinks, you throw them down. You're sad and angry. As they talk to you, the bar slowly empties.
You lower your head. Your thoughts circle until, after what seems like an eternity, you lift your head up again. There is nobody left at the bar.
Agitated, you get up, grab your jacket and stumble out of the bar as fast as you can. $singer and $drummer are drunk and babble something after you.

</ul>Shortly afterwards two other policemen enter the room. You know one of them, it's Mr. Müller. He gave me the talk about $herName a few days ago. Now he has some files under his arm.
He's about to start talking:

</ul>You sit on the bed in your tiny cell. After all, the handcuffs have been removed. You rub your wrists and stare at the floor.
How could this happen? You do not remember anything, yet you are sure you would never do something like this to $herName. You would never even have done this before the police was contacting you due to the risk assessment.
You try to think back to the night. Apart from the excessive amount of drinks, you can't think of anything else. You wanted to discuss with $herName. Then you had more drinks with $drummer and $singer. After that you left the bar - but what happened after that? You wanted to go home, but why the dirty pants?
Your headaches are getting worse. You hope a little sleep will help and you lie down on the bed.

</ul>You wake up by a knock at the door. Two policemen get you out of the cell and handcuff you again. They lead you back into the interrogation room.<ul>

</ul>In the interrogation room you see a gentleman in a suit. He introduces himself as Mr. Weber. He is your public defender.
He sits next to you at the table, while the two policemen from before sit opposite of you. The second one, Mr. Schmid, begins to speak.
He mentions that someone raped your acquaintance $herName that night. She had come to in the forest this morning and could not remember anything.
However, because of the message that she had sent to her boyfriend, it was clear that there had been a fight between the two of you. In this message she also wrote that she felt uncomfortable.
You get impatient and interrupt the policeman:

In addition, you were already under observation because of your behaviour. The risk assessment had shown a potential for violence and stalking tendencies. The boyfriend of $herName called the police when his girlfriend was still not at home at a late hour. The suspicion fell on you immediately.

Based on the victim's blood values, we suspect a blackout due to excessive alcohol consumption. Incidentally, the public prosecutor's office has already approved the remand in custody due to the situation. Oh and by the way, we have to seize the dirty pants of Mr. $myLastName as possible evidence.</i>
Your lawyer sighs and turns to you:
Mr. LastName, at the moment my leeway is severely limited. I cannot do anything against the decision of the public prosecutor's office at the moment. Would you like to say something to clarify the circumstances?</i>

<h3><b>GPS localization</b> and <b>geolocation</b></h3>
Generally <b>"Geolocation" describes the determination of a location</b> based on geographic coordinates. With <b>GPS localization</b> a device (e.g. mobile phone) is located via satellites. GPS can be accurate up to 30cm. Within <b>Geolocalization via data retention</b> the location defined by analyzing on which mobile phone antenna a device was dialed in. Since the retained data constantly records which mobile phone antenna a mobile phone has dialed in on, this results in an almost continuous recording of the device location. This type of localization is accurate to within a few hundred meters. Thus it is somewhat less accurate than localization with GPS.
<h3>Within the scope of the <b>data retention</b> the following <b>metadata</b> are stored:</h3><ul><li>Who called whom and when</li>
<li>How long the call lasted</li>
<li>Who logged on to the Internet when (and for how long)</li>
<li>Who sent an SMS to whom and when</li>
<li>Who accessed an e-mail box when</li>
<li>The location information of the mobile phone is also saved</li>
</ul><ul><li><<return "Back">></li></ul> <h1>Federal law on the carriage of passengers</h1><h2>11. Section: Supervision</h2><h3>Art. 55 Video Surveillance</h3><ul><li>1 Companies may set up video surveillance to protect passengers, operations and infrastructure.</li>
<li>2 They may contract video surveillance to third parties to whom they have delegated security services. The companies are responsible for compliance with data protection regulations.</li><li>3 Video signals can be recorded. They must always be evaluated on the next working day.</li><li>4 The video signals must then be stored in a theft-proof manner.
